Swiss Date Terms of Use

Comprehensive legal terms, disclaimers, liability limitations, and user agreements governing Swiss Date.

1. Operator Identity & Scope of Agreement

THESE TERMS CONTAIN A MANDATORY INDIVIDUAL ARBITRATION AGREEMENT, CLASS ACTION WAIVER, JURY TRIAL WAIVER, AND EXTENSIVE LIMITATIONS OF LIABILITY PROTECTING SWISS DATE. BY USING SWISS DATE YOU UNCONDITIONALLY AGREE TO BE BOUND.

The Swiss Date service, mobile application, APIs, and website (swissdate.app) are owned, published, and operated by Swiss Date (the "Operator", "We", or "Us") in Switzerland.

This agreement is entered into between you and Swiss Date as the primary beneficiary of all disclaimers, releases, indemnities, and liability caps herein.

2. Eligibility and account Requirements (Strict 18+)

Swiss Date is strictly restricted to adults. You represent, warrant, and covenant that:

You are at least 18 years of age (or age of majority in your jurisdiction);
You have full legal capacity and right to enter into this binding agreement;
You have never been convicted of, nor pled guilty to, any felony, sexual offense, crime of violence, harassment, or fraud;
You are not registered on any sex offender registry;
You will not use the Service for commercial solicitation, escorting, prostitution, or fraud.

3. Absolute Disclaimer of Criminal Background Checks

NO CRIMINAL BACKGROUND SCREENING: Swiss Date DO NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR POLICE INQUIRIES ON MEMBERS. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY AND VETTING.

You agree to exercise extreme caution and common sense in all interactions with members, online and in person.

4. Biometric AI Selfie Verification & Disclaimer

Profile verification compares a real-time live selfie against profile photos solely to assess likeness at that moment. The badge DOES NOT constitute a civil identity certification or moral character warranty by Swiss Date or Swiss Date.

5. Passport Mode & Approximate Geolocation

Passport Mode allows virtual teleportation to any Swiss canton or international city. Raw GPS coordinates are never made public. The Operator accepts no liability for travel arrangements or expenditures.

6. Offline Meetings & Complete Release of Liability

Communicating outside the app or meeting any user in person is undertaken 100% AT YOUR OWN SOLE AND VOLUNTARY RISK.

TO THE MAXIMUM EXTENT PERMITTED UNDER ARTICLE 100 OF THE SWISS CODE OF OBLIGATIONS, YOU HEREBY FOREVER RELEASE AND DISCHARGE Swiss Date FROM ANY INJURIES, ASSAULT, THEFT, ILLNESS, EMOTIONAL DISTRESS, OR CRIMES COMMITTED BY OTHER USERS.

7. Virtual Items, Coins & No-Refund Policy

In-app purchases are fulfilled by Apple and Google. Virtual goods possess zero cash value and constitute a revocable, non-transferable license.

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. In accordance with EU Directive 2011/83/EU Art. 16(m) and Swiss law, you waive any statutory right of withdrawal upon digital delivery.

8. Limitation of Liability (50 CHF Statutory Cap)

The total aggregate liability of Swiss Date shall be strictly capped at and never exceed the lesser of: (A) 50.00 Swiss Francs (50 CHF), or (B) the net amounts paid by you in the preceding 6 months.

9. Governing Law & Exclusive Swiss Jurisdiction

These Terms are governed exclusively by the substantive laws of Switzerland.

The exclusive place of jurisdiction is the competent courts of the seat of Swiss Date in Switzerland.
